Charges dismissed against Idaho man accused in hypothermia death

Charges of involuntary manslaughter and felony injury to a child have been dismissed against one of the men accused in the hypothermia death on an 11-year-old Idaho girl.

Robert Aragon and Kenneth Quintana were driving Aragon’s daughter and son to their mother’s house on Christmas Day when their car got stuck in the snow on an isolated stretch of highway near Shoshone. Aragon instructed the children to go ahead on foot in freezing conditions while the two men tried to get the car out.

Authorities later found the boy in a rest area bathroom, while the body of the girl was found buried in snow the next day.

On Friday, a 5th District judge threw out the charges against Quintana, agreeing with the defense attorneys’ argument that Quintana did not have custody of the children.

The same two charges remain against Aragon. (AP)
