A Valley County judge has cleared the way for the sexual assault trial against Nez Perce County Commissioner Mike Grow to begin later this month.
Grow is charged with forcible sexual penetration with a foreign object for allegedly assaulting a woman in April 2011 at a residence near Donnelly.
Grow’s attorney earlier asked for a continuance in the case if a previously barred expert witness was allowed to testify. At Thursday morning’s hearing in 4th District Court, the defense dropped its objection to allowing the witness, and withdrew a motion to allow another witness to speak during the trial through the Skype Internet connection.
The trial is scheduled to begin around Oct. 15 in Cascade.
