Mistrial declared in 2nd Lazcano trial

Gavel_3The brother of a man convicted of killing a Whitman County man is free after a mistrial was declared on Monday. 22-year-old Daniel Lazcano was freed from jail following his second trial on murder and kidnapping charges.

Lazcano was charged in the December 2011 shooting death of Marcus Schur in rural Whitman County. His brother, Frank Lazcano, was convicted earlier this year of murder and unlawful disposal of human remains.

When polled by Whitman County Superior Court Judge David Frazier, all 12 jurors said they could not reach a verdict in a reasonable amount of time.

Daniel Lazcano was convicted earlier this year of unlawful disposal of human remains for helping to dump Schur’s body in a creek near Bonnie Lake in Whitman County. He has not been sentenced for that conviction.
